“Si stima che la medicina difensiva impatti del 10% circa sulla spesa sanitaria nazionale totale. Risorse che potrebbero essere destinate alla prevenzione, tanto per dirne una, e che invece finiscono per gravare sulle spalle di tutti per far sì che i professionisti del settore non finiscano invischiati in complicati contenziosi legali. Contenziosi che i numeri ci dicono inoltre risolversi nella quasi totalità dei casi (97%) con un nulla di fatto, se non quello di intasare la nostra già intasata giustizia civile con ulteriori costi a carico della collettività“. Snocciola i numeri il broker assicurativo napoletano Angelo Coviello, imprenditore a capo di IGB Broker, anticipando parte del suo intervento previsto al Forum Risk Management in Sanità, in programma ad Arezzo dal 21 al 24 novembre.
Giunto alla diciottesima edizione, il Forum è un punto di riferimento per gli operatori del settore sanitario italiani. Coviello sarà relatore nel panel del 23 novembre ospitato dalla Sala Minerva del Centro Arezzo Fiere e dedicato alla depenalizzazione o alla miglior tipizzazione dell’atto medico illecito, rappresentando l’universo degli assicuratori e condividendo il tavolo con esimi giuristi, direttori sanitari e docenti universitari.
“Si parla di responsabilità medica – spiega Coviello – quando esiste un nesso causale tra la lesione alla salute psicofisica del paziente e la condotta dell’operatore sanitario in concomitanza o meno con le inefficienze e carenze di una struttura sanitaria. Questa definizione, solo apparentemente generica, ci fa comprendere bene la centralità del delicato rapporto tra l’esercizio del diritto alla salute da parte del cittadino e l’espressione della professione medico-sanitaria in tutte le sue possibili declinazioni, che si svolga autonomamente o in equipe, che si intervenga su una determinata patologia o sulla sua possibile insorgenza”. Sin dall’inizio degli anni 2000 la propensione alla copertura del rischio sanitario da parte del mercato assicurativo è stata altalenante. Si è, di fatto, assistito al progressivo abbandono dal settore delle compagnie tradizionali all’ingresso di nuovi operatori sia italiani che esteri. “Le compagnie assicurative – commenta Coviello – hanno alternato periodi di presenza nell’ambito sanitario e periodi di totale abbandono, costringendo le strutture spesso ad “‘autoassicurarsi'”.
“L’intero sistema sanitario – sostiene Coviello – può beneficiare della presenza delle compagnie assicurative nella copertura dei rischi da med mal,in quanto con tale soluzione si evita o comunque si riduce il depauperamento del patrimonio delle aziende dovuto alla ciclica necessità di indennizzare i terzi danneggiati. Non è superfluo ricordare cosa rappresenti, a livello di bilancio, la differenza tra l’alea del risarcimento e la certezza della spesa data dal premio assicurativo“.
Ma, conti a parte, la presenza di un’assicurazione migliora secondo il broker tutto il processo medico: “Non ricorrere alla medicina difensiva perché spaventati da possibili ripercussioni legali vuol dire innanzitutto garantire una cura migliore al paziente che non vedrà inficiato il percorso di cura da allungamenti di tempi dovuto a surplus di analisi che allungano i tempi d’intervento. Inoltre, l’assicurazione da un lato garantisce il medico e/o il personale sanitario che vede difeso il proprio patrimonio personale, ma dall’altro il paziente può accedere a risarcimenti in tempi minori, evitando lunghi processi extragiudiziari e con risarcimenti mediamente più alti di quelli ottenuti diversamente“.
“Non è un caso che i ministri Carlo Nordio e Orazio Schillaci abbiano istituito nello scorso aprile una commissione di esperti sulla colpa medica. Siamo convinti che l’assicurazione sia uno straordinario alleato per la risoluzione di questo problema”, conclude Coviello.
